1. GENERAL INFORMATION
These Terms and Conditions govern purchases made through the CHAOS2GOLD online store.
CHAOS2GOLD is an independent art brand operated by Daniel Martin, based in Biel/Bienne, Switzerland.
The online store offers original artworks created by Daniel Martin and Fine Art Prints produced through a specialised production partner.
By placing an order, customers agree to these Terms and Conditions, subject to any mandatory consumer protection laws that may apply.
2. PRODUCTS AND ARTISTIC CHARACTER
Original artworks are individually created by hand using materials such as charcoal, acrylic paint, gold accents, canvas, and paper.
Each original artwork is unique. Minor variations in texture, surface finish, canvas tension, or construction may be inherent characteristics of the artistic process.
Product descriptions, photographs, dimensions, and material information are provided to represent each artwork as accurately as reasonably possible.
Colours and surface details may appear slightly different depending on screen settings and lighting conditions.
Fine Art Prints are reproductions of selected artworks, produced on demand by Gelato.
Unless expressly stated otherwise, Fine Art Prints are not original artworks and do not include the handcrafted packaging reserved for originals.
3. PRICES AND PAYMENTS
Product prices are displayed in the currency indicated in the online store.
The applicable product price and any shipping charges are displayed during checkout before the order is submitted.
Any applicable taxes included in the displayed price are determined according to the store's checkout settings and relevant legal requirements.
International shipments may be subject to additional import duties, destination-country taxes, or customs clearance fees. These charges are generally not included in the displayed product price or shipping charges and are the responsibility of the buyer, unless otherwise expressly stated or required by law.
Payments are processed through the payment methods available at checkout.
Orders are processed after successful payment authorisation, subject to product availability and order acceptance.
4. ORDER PROCESS AND CONTRACT FORMATION
Customers select their products, review their shopping cart, provide the required delivery and payment information, and confirm their order through the checkout process.
Before submitting an order, customers have the opportunity to review and correct their order details.
By completing checkout, the customer submits a binding order for the selected products.
An automated order confirmation acknowledges receipt of the order.
The purchase contract is concluded when the order is accepted by CHAOS2GOLD. Acceptance may be communicated through an order confirmation or shipment notification, depending on the circumstances.
CHAOS2GOLD reserves the right to decline or cancel orders in cases of genuine product unavailability, obvious pricing errors, suspected fraudulent transactions, or other legitimate reasons, subject to applicable law.
Any payment received for an order that cannot be fulfilled will be refunded in accordance with applicable legal requirements.
5. ORIGINAL ARTWORKS AND AVAILABILITY
Original artworks are unique physical pieces and are generally available in a quantity of one.
Once an original artwork has been sold, it cannot be purchased again as the same original piece.
CHAOS2GOLD makes reasonable efforts to maintain accurate inventory information.
In the unlikely event that an original artwork becomes unavailable after an order has been placed, the customer will be contacted and any payment for the unavailable product will be refunded.
6. FINE ART PRINTS
Fine Art Prints are produced on demand through Gelato's international production network.
Production and fulfilment may take place in different countries depending on the customer's delivery address and production availability.
Print dimensions, paper specifications, and available options are described on the respective product pages.
Production and delivery times may vary depending on the destination and production location.
7. SHIPPING AND DELIVERY
Original artworks are shipped directly from my studio in Biel/Bienne, Switzerland.
Fine Art Prints are produced and shipped through Gelato's international fulfilment network.
Shipping costs and estimated delivery times depend on the product type and destination.
Complimentary shipping is offered for original artworks delivered to Switzerland, the European Union, the United States, Canada, and the United Kingdom.
A flat shipping fee of CHF 800 applies to original artworks delivered to Australia, New Zealand, Brazil, Japan, South Korea, Singapore, Hong Kong, and the United Arab Emirates.
Shipping charges for Fine Art Prints are calculated according to the destination and displayed at checkout.
Estimated delivery times are provided in the Shipping Policy. These estimates are not guaranteed delivery dates.
Delays may occur due to customs inspections, carrier operations, weather conditions, or other circumstances beyond reasonable control.
Nothing in these Terms and Conditions limits mandatory consumer rights relating to delivery or delayed performance.
8. INTERNATIONAL ORDERS AND CUSTOMS
CHAOS2GOLD is based in Switzerland and accepts orders from selected international destinations.
International shipments may be subject to customs inspections, import duties, destination-country taxes, and customs clearance fees.
Unless expressly stated otherwise, these additional charges are the responsibility of the buyer.
Any applicable charges may be collected by customs authorities or the shipping carrier before delivery.
Customers are responsible for providing accurate shipping information and cooperating with reasonable customs clearance requirements.
The allocation of customs-related costs and responsibilities remains subject to applicable mandatory law.
9. RETURNS, WITHDRAWAL AND REFUNDS
Due to the individual nature of original artworks and the on-demand production of Fine Art Prints, CHAOS2GOLD does not offer voluntary returns or exchanges for changes of mind or personal preferences.
This does not affect mandatory statutory rights, including any applicable right of withdrawal.
Customers in certain jurisdictions, particularly within the European Union, may have statutory withdrawal rights.
Original artworks and Fine Art Prints are not automatically exempt from such rights merely because they are handmade or produced on demand.
Detailed information about returns, withdrawal procedures, refunds, and applicable exceptions is provided in the Return and Refund Policy available in the shop footer.
10. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS
Every original artwork is personally inspected before packaging and shipment.
If an artwork or print arrives damaged, defective, or incorrect, customers should contact CHAOS2GOLD as soon as possible.
Customers are encouraged to provide their order number, photographs of the product, and photographs of the packaging where relevant.
Each case will be reviewed individually.
Handcrafted characteristics that correspond to the product description and agreed condition are not considered defects solely because they differ from mass-produced products.
Mandatory statutory warranty and consumer protection rights remain unaffected.
11. ARTWORK CARE AND HANDLING
Original charcoal artworks are treated with fixative and protective varnish.
Nevertheless, original artworks remain delicate artistic objects and should be handled with care.
Customers should avoid touching, rubbing, wiping, or cleaning the artwork's surface.
Artworks should be protected from excessive humidity, direct sunlight, extreme temperature changes, and mechanical pressure.
Damage caused after delivery through improper handling, unsuitable storage, or external influences is not considered a defect that was present at delivery.
Mandatory statutory rights remain unaffected.
12. COPYRIGHT AND INTELLECTUAL PROPERTY
All artworks, images, designs, photographs, written content, and other original creative materials published by CHAOS2GOLD are protected by applicable intellectual property laws.
Purchasing an original artwork transfers ownership of the physical artwork but does not transfer copyright or reproduction rights.
All copyrights and reproduction rights remain with Daniel Martin unless expressly agreed otherwise in writing.
Daniel Martin retains the right to photograph, document, publish, exhibit, and reproduce the artwork, including through Fine Art Prints.
Customers may not commercially reproduce, distribute, or exploit the artwork without prior written permission.
13. LIMITATION OF LIABILITY
CHAOS2GOLD takes reasonable care to provide accurate product information and reliable order fulfilment.
Liability for damages is determined by applicable law.
To the extent permitted by law, CHAOS2GOLD is not responsible for losses resulting from circumstances beyond its reasonable control.
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by Swiss law, subject to any mandatory consumer protection provisions that apply.
Any disputes will be handled by the competent courts in accordance with applicable jurisdiction rules.
Nothing in this section restricts mandatory jurisdictional rights available to consumers.
15. CHANGES TO THESE TERMS
CHAOS2GOLD may update these Terms and Conditions to reflect changes in products, business operations, or legal requirements.
The version applicable to an order is generally the version in effect when the order was placed.
Changes to these Terms and Conditions do not retroactively alter existing contracts without a valid legal basis.
